Can someone help answer a ?

I just (1/2 hr ago) got diagnosed with hep C and I know it is from my ex. Anyway my husband is going for a new job that he really wants. He is worried about, I guess they give a physical before they hire you. It's for a gas co. Do they check for hepc? and can they not give him the job if they did find him positive for hep c? Not sure if on a regular physical they just randomly check for hepC.

He cannot legally be denied the job even if he is hepatitis C positive.

To protect himself, he needs to get a WRITTEN offer letter prior to having any physical exams.

A recent (2002) Supreme Court decision specifically on employment and hepatitis C found that he cannot be denied employment UNLESS a specialist in liver disease says he is unable to perform the job. The company doctors are not sufficient to make this determination.

There is almost no circumstance where having hepC would eliminate a person from employment.

But protect yourself anyway and always get the offer in writing FIRST.

For more on the Supreme Court decision click "legal isssues" in the quicklinks on the website in my signature. The case is Echabel vs Chevron.

I hope this helps,

thanbey
