Impossible to say. Only a dr. can tell you how disabled you are. Having a herniated disc does not automatically mean you are disabled.

Never heard of disability from a one level disc herniation unless the herniated disc severely damaged the spinal cord or cauda equina. Herniated discs are commonplace and permanent disability is rare.

I don't know what state you are in but every state has their own formula. You can look it up on the web for your state. I know here in Mo your dr gives you a rating and then if you have an attorney they usually send you to one of their drs for a rating. When all that is done your attorney fights it out in court. I know here in Mo they do not consider pain and suffering.

It depends on the level of nerve compression. When I had my herniated disc, it was so large that I could barely take a step without crying out in pain. The nerve compression was such that it literally felt like my shin would split in two everytime I took a step. However, everyone's case is different, so it really is a case by case thing!
