think i just lost my job..very sad tonight

I called my boss to tell him i got in to see the doc tomorrow and he said if i cant work 100 % by friday.then dont come back!!!!!
The bosses wife is having surgery on monday and will be out for 6 weeks.He doesnt want to do anymore work than he has to so they got a girl in there right now training to take my place im sure!!!! I only claim 48hours a month on the payroll.the rest has been cash..I wouldnt be able to get diddly on workers comp or unemployment..The only other time i took off was for 6 weeks recouping from my hyst last sept..I had to take off 2 days because my back went out on me once..i have worked my behind off in that lil diner and this is what i get in return!!! I am not gonna be able to get a job anywhere being in this shape!!! I feel a major depression coming on!!!I will go to the doc in the morning and beg him if i have to for some meds that will get me back in shape so i can work..I love my job.the boss gets on my nerves and i work real hard but i loved the people and working w/my sis...My hubby is being very supportive so thats a plus but we really cannot afford for me to not work!!!!! We bought our first home 3 yrs ago and just cant make it w/out me bringing in some money...I know i am suppose to take this one day at a time ...I just needed to vent!!!! For those of you that believe in prayer please keep me and my family in your prayers...

Even if you only work 48 hours a month, you stil pay workman's comp. Every employer who has employees has to pay it, so worse case scenerio, if the injury is caused by work, or aggravated by work, you can collect OWCP.

They can't not let you go to the doctor's appointment or take time off of work. If you have to take time off you file for a Family Leave. This protects your job but you won't get paid while on it. If they fire you because of your medical problem then you file an EEO complaint.

You love your job. You don't love your boss. You have to figure out what is more important to you right now, your job or your health. Family leave is a law an available to everyone.

If it were me I would sit down and talk to my boss and point out all of your good points and what an asset you are to the job.

You have shoulder pain, right? Is this from your job? If it is, then you file a CA-2 OWCP claim. If it is a pre-exisiting condition and work has aggravated it, then you file a CA-2 form. If you have an acute injury, it just happened at work then you file a CA-1 form.

If you think that he is going to fire you anyway, and you hurt your neck or shoulder at work, then file. What could it hurt? I know that you went to the emergency room in the last few days, right? Go to him and talk to him. He might have a heart. Show him your medical papers. He does not want you to file a claim. Be gentle with him. Tell him that you love your job. By law they have to accomadate you.

Then, again, if you think for sure that he is going to fire you, file for Family Leave before he does fire you. That covers your bases.

I'm sorry for what you are going through with work among all your health issues as well. I certainly do believe in prayer and will pray for you and your family. I have a feeling things will be o.k. one way or another ....hang in there, and quite possibly that gentle talk might do the trick(?) Surgical Disaster

Ok i have lots of questions ..again.LOL
Just a refresher..I have buring in my neck that runs across my shoulders.Pain in my forearm and my pinky and ring finger on the right hand is mostly numb.I cant make a fist i cant even hold a pen!!! My 2 fingers feel like they are going to break if i try to make them bend!!

Both doctors that i saw said this is from overuse..Which would mean work related.Since i already went to the ER on my day off..Could i still file workers comp say today?.I havent even been back to work since this happened..My last day was on saturday!!

I called the boss today to tell him the doc says i need one week off work to rest my aching everything.LOL
Anyway when i called the boss yesterday he says if i cant come back 100% dont bother coming in at all!! He wants my all!! When i called today to tell him i have to take a week off.He was quiet and thinking about monday when his wife has surgery.

He has a new girl and my sis..He knows the new girl cant work the front alone and he is in a bind..so now he says what if you come in on mon and just do what you can...

Meaning all the real hard work would be on my sister and the new girl..Funny how yesterday when he was upset he tells me dont come back if i cant have your all and now the story changes cause he is in a bind!!!!!!

My doc said NO work because i could cause more harm to myself!!! I have watched my boss use people and make empty promises left and right in the 2 yrs that i have been there!! I have a very strong feeling...I will be let go right after his wife 's surgery is over!!! I just know him all too well!! I do NOT want to lose my job..however I dont want to lose complete use of my hand forever either!! Doc says NO WORK to rest my limbs...his is a very small place i dont think the family leave act would apply to such a small business.There are only 22 stools and no bathroom even...Not sure but i doubt that would apply ..I am interested in the workers comp though..I wont get much at all but something is better than nothing!!!!!! 2 doctors told me this is work related caused from overuse .I know it is from work.i havent been injured otherwise!! I am just wondering since i didnt go to the ER right from work if they would accept the claim???I absolutely have to do something for some income..Thanks again
