Can I sue the surgeon that made me this way? - Reflex Sympathetic Dystrophy Message Board

I don't know if I am grasping at straws or what, but I was wondering if I can sue the surgeon who performed my bunionectomy that caused me to have this stupid disease? I am so mad. I blame him for what is happening to me, because I didn't have rsd before the surgery, and now I am in pain every day. I am sorry I'm being a big whiner today. I used to be an ER nurse and ran my butt off 12 hours a night, now I can't wait until the next pain pill. Has anyone ever sued their doctor for putting them in this position? Is it hard to prove he made a mistake? My atty says he is having a hard time finding an "expert witness doctor type" to say there was negligence on the doctor's part. Just wondering if anyone could help me with this. Thanks

Hi Donna I feel your angier!! I have asked myself the same ? a million times! All I know is RSD is cause either by the injury it's self or by the surgery. I had the same surgery twice but I doubt it was because of error on my surgon's part.

My husband spoke with a lawyer today about this exact thing and was told that there is no way to prove just how or when we actually get the disease so in short the answer is no. the lawyer had actually just looked into this for his sister who suffers with rsd.

What makes me so mad is that this was elective surgery to help me with working the 12 hour shifts. My foot was starting to really hurt with all the hours I was putting in, and my doctor suggested getting the bunion removed to help out. My mom had the same surgery and was fine. So I did it and a 12 week recovery period turned into 7 mos off work and I lost my job. I am on disability from my job and was told I had to apply for Social Security Disability now too. Why is that? Why do I HAVE to apply for the SSD? I don't understand all of this. My works disabililty office sunlife told me I had to apply for SSD now. oh well. Thanks for listening. Donna*
