Morning,

I had the phone interview with SS disability on Tues. They told me what papers that they needed back and copies of my W2's and birth certificate. Well yesterday i got a letter from them saying that I bring in to much on my disability and i am unable to apply for SS D.

I am calling my lawyer today also , but has anyone else had this problem? I know i bring in disablility but that is goign to be runnig out soon and i have to pay for my own medical which i s 311$ a month andif i dont have disabli. comming in how am i goign to pay for this when i need it?? Thats why i started this is to cover my butt so i dont have to worry aobut this happeneing and of course now it is happening and its the last thing i need!

Bryn I ran into the same problem. See if you bring in more then 80% of your overall total incom you can't get ssd until it runs out. They take the last 5 yrs you worked, so if you made 20,000 for 2 yrs and nothing 1 yr and then 30,000 1 yr and 10,000 1 yr. that is 80,000 then devided into 5, then 80% of that is what they look at....somehow like that.

It is totally unfair, but it's the government. Once you private dissability runs out, you will be intitled to it. But talk to an attorney yours may be diff then mine.

Bryn, I agree, go see an atty now. The longer you wait, the more it will be harder to work with SS. He/she might know some laws or loop-holes to keep your application process going until your private disability runs out. It never hurts to check things out at any rate, and you won't get answers if you don't ask the questions.
