cheaper oxy coming soon?

[A federal appeals court found yesterday that Purdue Pharma had deliberately misled the government to win patent protection for its powerful painkiller OxyContin. The ruling, which makes patents on the drug not enforceable, opens the door to increased generic competition, as well as potentially huge legal awards against Purdue.

The unanimous ruling by a three-judge panel of the United States Court of Appeals for the Federal Circuit in Washington is a victory for Endo Pharmaceuticals Holdings, which is seeking to market a generic form of OxyContin.

Shares of Endo, based in Chadds Ford, Pa., closed yesterday at $24.63, up $4.60. Purdue Pharma is privately held.That finding of "inequitable conduct" invalidated Purdue's patent. The three-judge appeals panel also found, in reviewing the facts of the case, that Purdue had "failed to disclose material information that was inconsistent with its arguments for patentability."

The financial consequence of the decision could be significant for Purdue. Currently, 65 lawsuits have been filed by insurers and others seeking to force the drug maker to disgorge "monopoly," or excessive, profits as a result of the improper patent and the higher prices OxyContin commanded as a result of it.

Any damages awarded against Purdue in those cases could be substantial because OxyContin is an expensive drug and because the law allows for a potential tripling of any awards in such cases as a way of penalizing a manufacturer.]

It's about time! I was fortunate I had co-pay BC insurance which made it affordable for me when I was on Oxycontin. I was taking six 80 mg pills a day or 180 a month. I think my co-pay was $40, but I asked the pharmacist how much it would be if I didn't have the insurance and was paying out of pocket. He told me it would be $1,200 and change a month. No one can afford that kind of pricing! That's why so many people have to switch over to Methadone. It's the cheapest opiate on the market. I still have my BC insurance and I am lucky. I get 540 tabs of Meth a month for $15!!

Ahmen Director, It is about time. Their arguements against patent infringement were so flimsy anyway it never should have made it to court. First they argueed that the endo product was toooclose to their product therefore infringinging on their patent, in the same breath, the second attack was that Endo's product was not close enough to their product to be granted FDA aproval for generic status. So which is it? Too close or not close enough, But when the CEO makes 8 figures a year, a couple million in litigation and lobbying is adrop in the bucket compared to the Monopoly they had on LA oxy.

There was another CA lawsuite brought on by consumers and prescription insurance providors saying their claim of 12 hours of relief was strictly a ploy to increase sales of the short acting meds they made and suggested should be used for BT pain knowing BT meds would be needed for a product that didn't kllast 12 hours. Purdues own Oxyfast and OxyIR. Their strict enforcement of 12 hour dosing, denial of PAP aplications, the letters they sent out to docs and pharmacist telling them to refuse any script that wasn't written for BID ceratinaly increased BT med sales. Not to mention Purdue warning the dDA that docs precribing oxy more than twice a day were being weckless and ignoring the manufactures prescribing info.

I started LA meds with OxyC but at the time my script insurance had a 1500 anual cap, I know, great insurance. It took 3 months to max my yearly benefit on oxyC. The sad thing is, any fine will be recouped by gouging the publc some more on their new med Palladone, or any of their other product lines. When it all comes out in the wash, the consumer will be paying their fine. And the scrpt insurance providors will be reaping the rewards of any penalty. How about some govt regulation of pharmna companies that price gouge. a 500,000% markup does sound a bit like price gouging. What R& D has gone into Xanax in the last 2o years?

Anyone remamber this, whole sale cost of bulk pharacueticals.

It wil be interstesing to see what pan med are on medicares new prescription plan. I somehow doubt Medicare is gong topay 1400 a month for oxy C or 4k a month for aqtiq pops for people that don't have cancer. We all see more nd more meds dropped from script insurance prgrams s and hgher and hger copays for meds they do cover. But whan the pharmacuetical industry ah every congressemen and senetor wrapped neatly n there pocket I doubt we will see much change. Purdue will still gouge and those that can't afford these meds won't have access, quite a statement for the most powerful country in the world. Where the govt funds R&D through research grants, then gives a tax breaks fror R&D expenses, Our govt isn't going to bite the hand that feeds them.It would be like Congres cutting their own pay and fringe benis and cutting the strings of their own golden parachute for 2 years of public service. What's a marine get after 6 years of public service under the harshest wartime conditions when they have served their time, Nada?

Anyonme else see the curruption and inequity of government public service, not that you can really call being a congressman public service. It's more like that show where they stick people in the tube with cash swirling around and they get to keep all they can grab. Who puts that money in the tube, The laws congress passes for their own benefit and the money thrown at any govt official that has his hand out. When their are more pharma lobbysiats than we have congressman and senetors, something is severely worng, add in no oversight commitee to stop our electeted officials from selling out the folks that elected them for a multi milloin dolar play ball with the phama comanies or you won't be elected again.

dave hit the nail on the head.what we need is regulation of drug pricing.

over 40% of families are not covered by health insurance in the USA.
health insurance is now at an average of over $15k a year.surely drug prices must figure into the high premiums.

My morphine (without insurance) is now $1500/mo or $500/bottle of 60 100mg Kadians. I get #180/mo or $1500 - That is INSANE. If had to pay this out-of-pocket, the yearly total would be $18,000/year, or about 85% of my entire salary for the year!! And this is for a drug that is not "designed" or created in a lab somewhere. It's morphine! Comes from a plant! (or now, synth. produced)... been around for thousands of years! It's just crazy. When I looked into switching to Palladone, the cost was $1897/month for the same equivalent amout. This is why my insurance has the drug as "non-prefered". ( removed ).... the reps that sell it, (or don't sell it is more corrrect) call it "Palla-dog". Perdue sunk millions into this drug, and the reps can't get the doctors to prescribe it, the insurance plans to include it in their plans or the pharmacies to stock it... Perdue is going to lose MILLIONS of $$$ on this disaster of a drug!
