Question opinions needed...please help!!!

I'm new at all this so please bear with me...

Let me give you some background...
I live in a small 2 bedroom apartment with my fiance and our 2 small children. My oldest is almost 3 and my youngest is 6 months. My apartment is a double master suite.. or whatever. In each bedroom there is a bathroom. My 2 year old is officially potty trained. I use a small cushioned potty seat on top of the toilet.

Anyways....So here's what happened. At about 2 or 3 in the morning my 2 year old had a nightmare. I of course sat up with her for a few hours. About 15 minutes after she woke up she informed me that she needed to go "potty". So I helped her onto the toilet.The bathroom is small. When sitting on the toilet there is about 12-15inches between the toilet and bathtub on the left. I heard my baby crying so I told my 2 year old I'd be right back and to stay on the toilet until I returned. I quickly ran to get the baby. When I returned my daughter was climbing back onto the toilet from the left side. I asked her what happened and she told me she had fallen off the toilet and pointed at the small space between the tub and toilet. I checked her out and she seemed fine. When she was done we watched a movie till she was asleep. Later that day I noticed some light bruising around her ears and on her cheek. I believe she fell into the space between the tub and toilet and this caused her head to ricochet between the two, resulting in bruising on each side. I contacted her doctor and they told me what to look for and said if I noticed any of those signs to take her in immediately. She seemed fine so I stopped worrying so much. Five days later... a mother's worst nightmare... CPS showed up. They took my kids. Now I have to prove that my daughter injured herself when she fell off the toilet. They are trying to say I would hurt my children... I have plenty of character witnesses. I'm not too worried about that. I need to get my babies back. So... what I need to know is... Is it possible that my daughter fell into that space between the tub and the toilet. Could this have caused her head to ricochet between the two, resulting in bruising on each side of her head and ears? Also, I found out she had an ear infection. Could this be the reason she lost her balance?
