Unhappy Defeated

Today is 29 weeks since my hearing. My case was closed finally on October 19th. I still have not received my letter. I called my local office today. After being on hold nearly an hour I finally spoke to a man to try setting up an appointment so I could get the answer to my case. After over six months of waiting suddenly he told me! He said the judge had denied me. I won't know why until I get the actual letter. I started this process in February 2007. We've had to file bankruptsy but managed to keep our home. I was so looking forward to the day when I would finally feel vindicated. The doctor said I could not work. She filled out all their forms and wrote a letter on my behalf. The only question the judge asked me was, "Who took care of your son prior to him going to school?" I answered, "Me". I was very scared that day. After the hearing my lawyer said he would appeal if I was denied because all the evidence is there. They don't even know yet. I'll call and let them know in the morning but I'm sure they can't act on it until they have the letter in hand. I've been weeping for the past three hours and started throwing up. Sorry to be blunt but there is no other way to put it. I just don't know how to go on from here. I don't post much but I read constantly. This is just my story.

Sorry to hear of the set back. I don't understand one's thinking when it comes to these denials at times. It just simply makes no sense. I hope and pray that it was not a decision based on the fact you have a child. That in and of itself sounds like discrimination to me. What does one do when they become disabled, give their children away? No, you make the best of what faces you. I know what it takes as some years ago, I had to leave a specialty college program to care for a spouse with cancer.
We went from two incomes, (I also worked part-time during school) to no income as it was necessary to have round the clock care for my husband. We do what we have to when it comes to family. I wish I could say something encouraging, but right now I am seeing red. I hope and pray that your attorney can devise a game plan for you and yours. Try not to let it get you down. I know I have watched my granddaughter when it was necessary during some family crisis. It is not easy, but I am her grandmother and she will not stay with any one else. People have to live and we have to survive in good times and bad. I am sure sorry you ended up with a narrow-minded judge. Try to take it in stride and press on. It sounds like your doctors are supporting you in your claim. I do hope you can find the strength to keep your chin up and press onward. Don't give up!

Yes, it sounds like you ended up with a bad judge, which can happen. Sounds like a sexist pig to me....Asking you who took care of your child. What the heck? He probably thought that because you could care for your child, you could work. Two entirely different things, sir!! With all due respect, he's probably one of those career men who's not involved much with their kids and thinks the woman should do everything. Just because he can't handle kids, doesn't mean others can't. He shouldn't be letting his own opinions enter into the case....He's supposed to consider the medical documentation and which side has a preponderance of the evidence, or 51%. A Doc clearly saying you can't work is far more than 51% to me!

I agree with Goldyfm....Don't give up. That's what the "system" wants you to do. They want to wear people down and give up. Stay strong and keep fighting. Your lawyer knows what to do. People like you who have good medical documentation a firm Doc in your corner almost always eventually win.

Hi Wishi,
I do not see the connection between having a child and being disabled either Their are many disabled parents out in this world with children . .. Yep, that was a bad judge , allright . What a moron . I am very sorry. And PLEASE , do not give up!!!
Keep fighting your claim, keep going, as long as you can! Do not let the system win.
I have a son, he is disabled with autism, and I am disabled too. He was disabled , and I have been disabled off and on for yrs. Than became fully disabled , however, thankfully did not have to go through the something as stupid as you had to go through, in which I feel is so wrong. my heart goes out to you .
It is very worng what happened . Hope things will improve.

Oh and one more thing, I have been in the hospital, those times are so terrible, I am a single mom, I have family step in and care for my son, and dogs. Yes, they are there through the rough times. Thankfully they are . Again, family is there. My brother and sister N law. I have been in the hospital many times . SO thank goodness for their support.
I do not understand what having a child has to do with being disabled ?? Absolutely nothing. That is one big cop out . Stuid excsue to deny somebody who is disabled.

Sounds like someone dropped the ball in your case. I would suggest writing a letter of complaint regarding judge and anyone else who may need to be complained about. Do this asap! Also, what has your attorney been doing during this 29 weeks of waiting after the hearing? This kind of crap from SS is just plain wrong. If you need help with letter ask someone in your family. Bullet point key health issues along with date of hearing and when you FINALLY heard that case was denied--then let your complaints flow like water.

Sometimes I wonder if my calling in life is to be an advocate of some kind--I am so sick of SS (gov. in general) treating Americans who have worked all their lives, ask for help, then get kicked in the groin!

Wishi--hang in there and do not let this go! Fight those bureaucratic A$$e$!
