The use of an upper or lower splint or both generally depends on what the problem may be and the drs training and what theory of treating tmj he subscribes to.
Lower splints are generally used to reposition the lower jaw and some are designed to push the lower jaw down and forward to allow discs to be recaptured. Upper splints allow the lower jaw to go where it can go - the idea being it will go where it is most comfortable. Some upper splints address cranial alignment issues and some just increase vertical dimension within the mouth by preventing back teeth from touching which increases space for the joints to function better.
In your search for a dentist check to see if they are trained in FJO (functional jaw orthotics) - this means they are at least familiar with varioius splints and their uses and do not limit their treatment of your case to a "one size fits all" approach.
