Whether your injury is worth a lot or a little is a function of the following:
- The basis of liability for the injury,
- The objective level of proof of the injury,
- The nature and course of treatment, and
- The person injured.
If your injury is work related, and your claim is for compensation benefits, then there is a schedule which the judge applies to determine the amount of your award. If your injury is not work related, or there is a third-party at fault for the injury, then your claim is not restricted to the worker's compensation schedule, and the amount of your award/settlement/jury verdict is not limited by the arbitrary comp schedule. If you have a 'third-party' claim, and strong objective proof of CTS on an EMG, with surgery, then your case is very valuable. In some cases, it is worth over $100k..... But it depends on the particular circumstances of your case.
