Question about property during divorce
 
Bought a house but under my dads name since neither of us had good credit. We are currently written down as renters n husband is threatning to sell the home. Ive made most of the payments on this home. Can he lawyer up n take the house thats under my dads name only because its something we got together while married ? Our names are no where on the mortgage . Im stressing so much over his threats n dont know what will happen. We have already filed for divorce and waiting on court hearing.

Well, obviously you should have an attorney if you are going to court and she should be communicating with your husband's attorney - not you and he conversing. Second, if you have a written lease with your father, it will dictate whether or not he can be evicted. And lastly, he can't sell something he doesn't own.

Only your father can sell the property in his name, and he has no obligation to allow either of you to live there. Neither of you have any legal claim on the house. Not in any manner.

You each are renters. You should talk to an attorney as to the things in the house, as soon as possible.

Regardless why, you set the property up that way. Legally neither of you have any legal say about the property. Your father can evict both of you and sell it and keep the money. Not putting having your name on the deed was not a good plan.
