    eye flaps moving after lasik

My eye flaps moved the day after having Lasik eye surgery. This has caused me lots of problems with my vision. The Doctor said they moved because my eyes are uncommonly dry and when I first woke up and blinked this caused my flaps to move. Could this Doctor be liable for neglegance? I mean if he is an eye specialist shouldnt he have known my eyes were uncommonly dry and have some sort of protective lens over them?
