    Personal injury in car accident & insurance adjuster saying not caused by accident

    Hi:

    I am 57 years old, male, and had a car accident while waiting at light, and got a hit from rear from GMC truck. The airbag of the car hitting my car got inflated. I have severe pain in neck, left shoulder, left arm, and fingers still going on. 2 epidural injection in the last 6 weeks did not do much.

    The adjuster called me today to tell me that she does not see anything in MRI report that this discomfort is caused by car accident, as she says that this is disc degenerative disease and indirectly coming from age.

    I will appreciate someone expert can validate or refute the above position.

    I am taking the following medicine for pain killer and managing pain:

    Hydrocrodon Acetaminophen 10-325 (every six hours for pain)
    Meloxicam 15mg
    Gabapentin 100mg Capsule ( daily)

    I am giving below my MRI report.

    Any comments or suggestion please. Thanks

    EXAM: MRI C-SPINE W/O CONTRAST
    CLINICAL INFORMATION: Degeneration of cervical discs.

    INTERPRETATION:
    1. Mild reversal of the cervical curve with center at C5-6.
    2. Broad-based central disc protrusion at C5-6 of 3.1 mm. Central stenosis with diminished canal diameter to 5.5 mm and focal cord compression. Also bilateral foraminal stenosis (See below).
    3. Left lateral and intra foramonial disc protrusion at C6-8 of 2.33 mm with foraminal stenosis.

    COMMENTS: MRI of the cervical spine was performed on the Siemens Verio 3 Telsa Magnetom. The following sequences were obtained.
    1. Coronal T2 weighted images.
    2. Sagittal T2 weighted images.
    3. Sagittal T1 weighted images.
    4. Sagittal STIR images.
    5. Axial T2 MEDIC images.
    6. Axial T2 Weighted images.

    There is a mild and segmental reversal of the cervical curve with a center at C5-6. Between C2 and C5 there is no disc disease.

    At C5-6 there is a central and very broad-based disc protrusion measuring 3.1 mm. This results in thecal sac and spinal cord compression with substantial deformity of the cord parenchyma ventrally and displacement posteriorly.

    Images and the report can be viewed on the Ramsoft Imaging web portal.

    At C6-7 there is a left lateral and intra foraminal disc protrusion of 2-3 mm causing significant foraminal stenossi. This is best seen on axial image 13 of series 8 and sagittal image 8 of series 6.

    There are no other major findings.

    Mri also notes a herniated disc at c5-6. You should consider talking to an injury lawyer as the insurance company will not be impartial.

    Talk to an injury lawyer.

    Insurance companies hate paying out money.

    Welcome to the board. What special training does the insurance adjuster have in spinal injuries? Are you seeing a spine specialist --either a fellowship-trained orthopedic spine or neurological surgeon? If not, you should make an appointment with one because there is evidence of cord compression and you should get it checked out!

    By the way, none of us are experts or even have formal medical training. Rather we are fellow "spineys" who come together to share personal experiences and knowledge we have picked up along the way.

    I believe what the adjuster may have seen is the following: "Between C2 and C5 there is no disc disease.

    This implies that there is disc disease elsewhere...but, the disc herniation and disc protrusion could very well have been caused by the impact of the accident and the air bag.

    The disc at C5-6 is protruding, meaning that disc material is pushing out of the disc space and is pushing into the thecal sac and pushing into the spinal cord. The normal diameter of the canal is about 12mm. Yours is reduced in size to 5.5mm and that means the cord is being compressed. This needs to be evaluated by a spine surgeon.

    This is the significant finding of the report and the reason why you need to see a spine doctor. I don't know that much about the cord parenchyma...it is the inside of the cord...and I'm pretty sure you don't get substantial deformity of it from degenerative disc disease or wear and tear.

    The thing is, the MRI is one piece of the diagnostic puzzle. To be meaningful, it must be correlated with what the doctor finds on physical exam and basic neurological exam. The orthopedic spine or neurological surgeon will give you the most accurate diagnosis and plan for treatment.

    Regardless of the insurance adjuster, please see a spine specialist!
