Yes, actually there is case law on this very subject. Several people in the state of California have successfully sued someone for knowingly giving them herpes. I'm sure it has been litigated in other states as well.

: Just curious... If someone knows they have Herpes is it illegal to expose others to it without their knowledge? Even if you wear a condom, the virus can be transmitted orally. Since I am now seeing ads stating how having herpes can increase the odds of getting aids, and how herpes can even cause death in rare cases(got that part from the doctor's brochure) I would think putting someone's life in danger without them knowing about your condition would be criminal.

: Would this fall under general rulings, or does anyone know of specific laws on the books?
